В Якутии вынесен приговор по уголовному делу о покушении на дачу взятки должностному лицу в крупном размере. Начальник отдела земельного отвода ООО «ГЕОТЕК – Восточная геофизическая компания» признан виновным в совершении преступления, предусмотренного ч.3 ст.30 - п. «б» ч.4 ст. 291 УК РФ (покушение на дачу взятки должностному лицу, с целью освобождения от уголовной ответственности, в крупном размере), сообщает пресс-служба СУ СК Якутии.
Следствием установлено, что 17 апреля 2015 года руководителем лесничества – лесничим ГКУ РС (Я) «Вилюйское лесничество» в местности «Среднетюнгское нефтегазовое месторождение» выявлен факт организации незаконной рубки лесных насаждений обществом с ограниченной ответственностью «Газпром георесурс» производственным филиалом «Костромагазгеофизика». По результатам выявления и проверки лесничий составил протокол о нарушении лесного законодательства.
Общая сумма ущерба уничтоженных и поврежденных до степени прекращения роста деревьев на основе расчета ущерба, произведенного ГКУ РС (Я) «Вилюйское лесничество», составила около 16 миллионов 250 тысяч рублей, что относится к особо крупному размеру.
О выявленных нарушениях лесного законодательства стало известно начальнику отдела земельного отвода, который приехал в г. Вилюйск для представления интересов ООО «Газпром георесурс».
Опасаясь, что работники предприятия могут быть привлечены к уголовной ответственности и не желая данных последствий, представитель компании 28 мая 2015 года в кабинете руководителя ГКУ РС (Я) “Вилюйское лесничество” пытался передать лесничему в качестве взятки денежные средства в сумме 300 тысяч рублей.
Однако преступный умысел обвиняемого не был доведен до конца по независящим от него обстоятельствам, так как руководитель лесничества деньги не принял.
Приговором Вилюйского районного суда Республики Саха (Якутия) от 25 мая 2017 года подсудимый признан виновным и осужден к пяти годам лишения свободы с отбыванием наказания в исправительной колонии общего режима со штрафом в размере 18 миллионов рублей.
Уголовное дело возбуждено по материалам проверки, проведенной прокуратурой Вилюйского района.
